These Terms and Conditions apply to all purchases of Goods which are sold by Nutrivend Ltd t/a Nutristore. By placing an order on this website you agree to abide by these Terms and Conditions.

We reserve the right to change these Terms and Conditions at any time. Any such changes will take effect when posted on the website and it is your responsibility to read the Terms and Conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest Terms and Conditions.

In these Terms and Conditions (the “Conditions”) the following words shall have their corresponding meaning:

“Buyer” or “you” refers to the person(s), firm or company who purchases the Goods from the Company.

“Company” Nutrivend Ltd t/a Nutristore registered in England and Wales Reg. No. 07992311

“Goods” any Goods agreed to be supplied to the Buyer by the Company (including any part or parts of them).

"Delivery Date" the date on which the Goods are to be delivered as stipulated in the Buyer's order and accepted by the Seller.

“Contract” any agreement between the Company and the Buyer for the sale and purchase of the Goods, incorporating these Conditions.

  • We will not be liable for direct, indirect or consequential loss or damage arising under these terms and conditions, whether arising in tort, contract, or otherwise, including, without limitation, any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings.
  • We will not be held responsible for any loss suffered by the use of any products purchased by customers containing ingredients prohibited by a sports governing authority or by a relevant anti-doping agency. We encourage any customer participating in a sport to check any rules and regulations regarding the use of any supplements before purchasing any product.
  • We will not be liable for any medical defects, ailments or illness suffered by the customer from the use of any products. All customers purchase products with full knowledge of their ability to consume them. If there is any doubt of a customer’s ability to use any products, we encourage the customer to seek professional medical advice.
  • We will not be liable for any claims made by any product.
  • We will not be liable for any direct, indirect or consequential loss or damage arising under these terms and conditions or in connection with our website.
  • We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your right to have the products sent to you within a reasonable time. If the delay occurs before the products are dispatched, we will not charge you for the products until they are dispatched, and you may cancel your order at any time prior to dispatch.
  • The laws of some countries do not allow some or all of the limitations described above. If these laws apply to you, some or all the above limitations may not apply to you and you might have additional rights.
  • Nothing in these conditions limits or excludes our responsibility for fraudulent representations made by us or for death or personal injury caused by our negligence or wilful misconduct.

RETURNS AND REFUNDS

We appreciate that in times it may be difficult to purchase a product over the Internet, especially when you can only see a picture and description of a product. Should you wish to return purchased goods back to us, we will be happy to refund or exchange them provided they are totally unused and in a fully resalable condition within 28 days of purchase.

How to Return Goods bought On-line:

We will advise you whether to return the goods to ourselves directly or the manufacturer depending upon the problem. We accept the return of goods sent back to us if you follow the below conditions. We will refund you any money which you have paid us for the item or offer you an alternative product of similar value as a replacement if required, If the similar product is cheaper, we will automatically refund you the difference. The only costs you incur is the return postage of the unwanted goods and our postage costs we incurred for sending the goods to you. We do not, however, accept the return of opened and/or part used goods.

  1. If you want to refund an unwanted item, please make sure you notify us within 14 days from the date you received the item, this is also known as a cooling off period.
  2. From the date you notified us regarding the cancellation you then have another 14 days to get the item back to us.
  3. If you return your purchase by post or courier after the periods outlined above (with the exception of faulty or damaged goods), CSN reserve the right not to offer you a refund in full. We may instead return your purchase to you. Prior to sending, the cost of re-delivering the item will be at your own expense.
  4. No refund or exchange will be given without a receipt, dispatch note or other proof of purchase.
  5. Refunds can only be given for products which are returned to us in their original condition. We cannot issue a refund for any item which has been opened or used.
  6. Photo evidence will be needed for all damaged items that need to be returned.
  7. Any item sent back to us over the over the outlined time frames will not be refunded, it will be your own responsibility for re-delivery or collection of the item.
  8. We will refund you within 14 days of receiving the item back.
  9. Refunds will be paid to the original payment method.

If an item bought online turns out to be faulty, then you are protected by the same rights that apply to purchases made in person. We will re-imburse you for the cost of sending the item back to us. We will need to see the cost of delivery receipt to re-imburse you for the returned item.

If you have an item that was faulty or damaged at the time of sale, it needs to be returned to us within 30 days for a refund.

We suggest you use a carrier which offers recorded delivery to ensure that if it does not arrive with us you can put in a claim in through the courier as the goods are not our responsibility until we receive the item back. Please use sufficient packaging to ensure the contents are not damaged in transit.

If an order is returned to us because no one has been at the shipping address invoice to receive the item and no other arrangement has been made between the customer and the courier, the returned item will be refunded minus the amount the item cost us to send out to you, plus an additional charge the courier has charged us for returning the item back to us.

If an order is returned to us because you have entered incorrect/missing address information on the sales invoice and the carrier isn't able to locate your address the returned item will be refunded minus the amount the item cost us to send out to you plus the additional charge the courier has charged us for returning the item back to us.

If the customer has refused delivery (with no mistake on our part) and the item is returned to us, the returned item will be refunded minus the amount the item cost us to send out to you plus the charge the courier has charged us for returning the item back to us. Refusal of correct deliveries is deemed to be breaking our terms and conditions unless there is a mistake with the order, or the order has been damaged in transit.

The current charges for unsuccessful deliveries which get automatically sent back to us, which is no fault of CSN are set below depending on destination, courier used, and type of service requested:

Whilst we do try to keep all our info pages polite and friendly, for legal reasons brought about by a minority of our customers, we do need to state that it is the customer's responsibility to ensure that they are present to sign for the parcel. In no way can CSN be held liable for failed deliveries unless the courier service used has been negligent in their duty to deliver, therefore we would claim against the question courier company.

We have an agreement with all of our couriers that if no one is home to receive the goods at the mentioned delivery address, they can leave the item in a safe place, this is an automatic feature which enabled on all accounts, if you wish to disable this feature you can do this on the couriers apps prior to delivery or you can email us at Orders@csnsupps.com after checkout and before the item has been dispatched

Products That Cannot Be Returned:

The following items cannot be returned within the terms of our refund policy:

  • Gift Cards
  • Frozen or perishable goods
  • Samples or free items

CHANGES TO YOUR ORDER

You have a right to cancel your order and receive a full refund prior to goods being dispatched. To cancel an order before the item is dispatched it is FREE, once the item has been dispatched, delivery & redelivery charges will be deducted from the original cost paid, you are advised to contact us first on 0800 669 6727, then second option if the first option is unsuccessful would be to email us at customerserviecs@nutrivend.co.uk

  • In respect of non-perishable items, you have the right to return goods within 14 days of receipt of your goods in perfect condition, unused and in their original packaging. We ask that items are returned to us with their original packaging and with any tags intact. You must also contact our customer support team to notify us prior to returning the items.
  • In the case of items which include a hygiene or security seal, we ask that you exercise reasonable care by not removing the seals while examining the goods, unless you are certain that you intend to keep the goods. If any seals or tags are removed or tampered with, we shall not permit that item to be returned nor shall we refund the cost of this item to you.
  • We will arrange with you for cancelled non—perishable goods to be returned to us, and we will credit your payment card with the price of such goods within 14 days from the date you returned the goods to us (provided payment has already been debited to your payment card).
  • The cost of postage, packaging and the insurance relating to the return of unwanted goods back to our warehouse are fully the responsibility of the customer; furthermore the postage cost of the original consignment of the goods will be deducted from any refunds.

OFFERS AND PROMOTIONS

From time to time, and in our complete discretion, purchases of goods may be subject to special offers. In the

event that such a special offer applies to your purchase, the terms of such special offer shall be subject to

these Terms & Conditions. If there is any conflict between the terms of a special offer and these Terms &

Conditions, these Terms & Conditions shall prevail unless specifically excluded.

  • I We may change the terms of special offers, or withdraw them altogether, at any time and without prior notice.
  • We will honour at the offer price any order placed by you before an offer ends, or is amended, withdrawn with the exception of allocated stock shortage for the specific offer.
  • We reserve the right to offer in our complete discretion different customers different special offers and promotions.

COMPLAINTS PROCEDURE

We aim to deal with all complaints effectively. For a speedy response complaint may be submitted via our online utility, or alternatively mailed to the registered head-office.

We aim to acknowledge by email any emailed or mailed complaint within 5 working days, and to conclude our investigations as soon as possible thereafter. Telephone complaints will not necessarily be acknowledged by email prior to investigation. A likely timescale for resolution will be provided upon request, but this timescale will be dependent upon the specific nature of the complaint.

CANCELLATION OF ORDERS AND SUSPENSION OF YOUR MEMBER ACCOUNT

We reserve the right to cancel your delivery at any time if we suspect fraud, have reason to believe you are in breach of these Terms and Conditions or any other terms and conditions relating to your order, or if there is an outstanding payment for any order or service. For example, if you are in breach of our terms and conditions relating to discount offers and vouchers, we may cancel your order. In the event that we cancel your order, you will receive email notification and will be invited to contact our call customer support team.

In addition to our right to cancel your order, we reserve the right to suspend your account. Your account will remain suspended until you contact our customer support team and remedy any breaches which are capable of remedy, or provide any information reasonably requested by our call centre advisers to enable them to reactivate your account.

In the rare event that unforeseen operational or technical issues occur, we may need to cancel or rearrange delivery. If this happens, we will endeavour to contact you to arrange an alternative delivery date.

VALUE ADDED TAX (VAT)

All prices on nutristore.co.uk are quoted inclusive of relevant UK VAT to provide a transparent and honest pricing structure.

METHODS OF PAYMENT

Orders can be paid for using VISA, Master Card, Switch/Maestro, Solo, Electron, American Express cards and Bank Transfer.
  

  • Authority for payment will be requested from your card issuer between the time of your order being placed and when it is delivered. This is done by 'reserving' against the card you have used for payment. The amount that is ‘reserved‘ will either be the estimated amount of your order. That amount is not spent by you until we 'debit‘ your card with the full price of your order, and the latter happens after we have delivered your shopping to you.
  • We reserve the right to cancel your order if we are refused authority for payment or reasonably believe that payment will be refused at any stage.

OUT-OF-STOCK ITEMS

If any item you have chosen is unavailable, we will contact you via your e-mail address or via phone within 3 working days from receiving your order.

WARRANTIES

All products on Nutristore website are designed for home use and carry a home use warranty only, unless stated otherwise. Equipment purchased from our website and used in a non-domestic environment will render the warranty null and void unless the equipment description states it is suitable for commercial use.

  • I Fitness equipment sold by Nutristore are covered by a minimum one-year parts and labour cover. In many cases the warranty is greater than this.
  • The warranty on equipment we sell varies from manufacturer to manufacturer. It can include a full on site repair facility or a ‘back to base' warranty. In some cases, where there is a minor fault, the manufacturer will send a part by mail for the customer to fit.
  • No goods will be accepted into our warehouse without prior authorisation from Nutristore. Nutristore will then repair or replace the equipment with an equivalent or better model and deliver the goods back to the customer at our expense.

WEBSITE AVAILABILITY

We do not guarantee that our site or its' content will always be available, nor do we guarantee that we will provide an error free service. We may suspend our service for operational reasons such as repair, maintenance or improvements, or otherwise in emergencies and we may change or discontinue the availability of any content, goods or services at any time as we see fit.

DELIVERY

We will endeavour to despatch goods as promptly as possible; this is usually 1—3 days within UK Mainland.

Delivery time frame (and the cost if any) specific to your order is quoted within the order confirmation page once you submit your delivery location. This is due to the fact that we can only calculate the estimated delivery to you once we know your delivery location.

  • We undertake to inform you of any subsequent change to the delivery time within 48 hours of receiving your order.
  • Couriers and delivery services we use tend to deliver during the working day. You may find it easier to give a work address if it is unlikely that anyone will be in to sign for your order.
  • For heavy or bulky items we reserve the right to charge a redelivery fee if the customer is not there to collect the goods as arranged.
  • Standard delivery is between 9am and 6.30pm. Saturday deliveries may be available on certain products.

  • If access for delivery is restricted, please ensure that you inform us prior to delivery. Failure to do so may result in an additional shipping charge. Examples include gravel pathway, 2nd floor without a lift.
  • Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or cancelled delivery. If that is the case, we will endeavour to contact you as soon as we are able to in order to reschedule your delivery time and date. In any event, our liability to you will be limited to the price of goods not delivered and the cost of delivery.

SIGNING FOR GOODS

Upon delivery of goods please check them carefully for signs of possible damage before you sign to say that you have received them in good condition. It is not always possible to determine if the internal contents have been damaged and we strongly advise you to cross out the word ‘Received in good condition’ and write ‘Damaged’ before you sign, or to write ‘Damaged' above your signature. This is to ensure that, if necessary, a claim can be made against the courier company.

Unfortunately, our carriers accept no other wording and it is extremely difficult for us to claim that your goods were damaged in transit if you have previously signed to declare that you received your order in good condition.

If you receive a parcel, which is obviously damaged beyond all levels of acceptability, you must REFUSE the delivery. Do not sign for the items, then contact us immediately stating the reason for refusal. We will then resolve the problem in the best and quickest means possible. Fortunately, this happens very rarely.

BFPO Information:

When ordering to a BFPO address it is the customer’s responsibility to make sure that the items are within the weight limits for that particular BFPO address. All orders to BFPO address will be shipped individually to keep the individually packaged weight down. We will track the orders to the BFPO hub where it will be signed for and then shipped to the individual. Once an item has been received by the BFPO hub CSN Supplements accepts no responsibility for lost or missing items in the onward delivery process. Please be aware that if an item is too heavy for then BFPO address the item is not returned to sender but disposed of by the BFPO Hub.

Please note:

All delivery time estimates are subject to stock availability and receiving your order by 4:00 pm the day you made the transaction. Orders placed after 4:00 pm on the day of transaction will be processed next working day. Orders are not processed or delivered on weekends and bank holidays. Furthermore, due to the volume of parcels around bank holidays, in particular, Christmas, parcels may be delayed by our couriers. For example, if you completed your transaction on Friday at 5:00pm asking for Next Day Delivery your items will not be packed until Monday and your items should be delivered on the Tuesday.

If for any reason we expect that your order will not arrive within the specified times, we will e-mail or call you shortly after receiving your order. It is therefore particularly important for you to provide a valid e-mail address and contact number that we can get hold of you on. Please be sure to check your e-mails and phone messages shortly after placing the order in case we need to contact you.

We accept that unfortunately there may sometimes be occasions when, for any reason, there is a problem with delivery. It may arrive late; it may arrive damaged; it may not arrive at all. In any of these cases, we will endeavour to ensure that a replacement is arranged with the absolute minimum of fuss for you, and that you get a full refund for any postage you have paid. Incorrect delivery information as stated by the customer is the responsibility of the customer, who will be liable for any re-delivery or return charges.

Lost Parcels:

We insure all of our parcels, in an event of your parcel goes missing we will take full responsibility in refunding or replacing your item at no additional cost as long the claim is not fraudulent. Claims can be made 7 working days from the date the item was supposed to be delivered.

Parcels Damaged in Transit:

If a parcel is damaged in transit we will take full responsibility, please refer to our Cancellations & Returns policy for further information.

Parcels Delays:

If a parcel does not arrive within the estimated time frame, firstly always check the tracking information provided to you, if you don’t have this, please email orders@csnsupps.com for the relevant information. Secondly contact the courier company as we only know as much as them and if any questions are still left unanswered after your contact with the courier we will take ownership, we will email the relevant courier/department for you, the estimated turnaround times for CSN to receive contact back from the couriers are between 24/48 hours.

Change Of Carrier Service:

There might be rare occasions where we might have to change your selected / preferred carrier service to another carrier. This might be due to weight restrictions, unprecedented demand for their service or infact a delivery which is not possible due to a destination issues. For these rare occasions, the switch to another Carrier will be a like for like service e.g, next day delivery, delivery before 10am etc. We will cover all additional costs for the amended service and in the rare case where the new service is at a cheaper cost, we would then honour a refund for the difference in price.

Courier Strikes:

Finally, if one of our delivery companies go on strike any reason, we won't be held responsible for compensation refunds for parcels which arrive outside the estimated delivery time frame, therefore if you wish to pursue a claim for a late delivery we are able to action a claim against the mentioned delivery company, claims can take up to 14 days for a successful compensation claim, then a further 7 days for the refund to be deposited back into your account via the original payment method. (This is the same timeframe for claims against lost parcels)
